Mana Vault Terms of Service


Introduction:

1.1. These regulations define the rules for the provision of electronic services by the Administrator of the Mana Vault web application (hereinafter referred to as the "Application") to the Users (hereinafter referred to as the "User").
1.2. The privacy policy is an integral part of the Regulations.
1.3. The Regulations have been drawn up based on the provisions of Polish law.
1.4. Definitions used in the further part of the regulations:
- Personal Data - means the User's personal data provided during registration in the Application, including name, surname, email address, password, and optionally provided location (e.g. country/city).
- Registration Form - means the form available on the Application's website, used to register the User in the Application.
- Price list - means the price list of the Application's services available on the Application's website.
- Mobile Application - means the Mana Vault mobile application available on Android devices available in the Google Play store
- Account - means an individual User account created in the Application on the basis of the data provided by the User in the Registration Form.
- Plan - means one of the four available variants of using the Application: Common, Uncommon, Rare, Mythic, described in detail in the Price List tab
- Service - means a service provided by the Administrator via the Application.
- User - means a natural person who has registered in the Application in accordance with the provisions of the Regulations and has an active Account.
- Privacy Policy - means a document available on the Application's website, specifying the rules for processing the User's personal data.
- Magic: The Gathering - a collectible card game that was developed by Wizards of the Coast.
- Wizards of the Coast - an American company that designs and publishes board and card games, known mainly for its flagship game Magic: The Gathering.
- Google - an American technology company specializing in the provision of Internet services and products, including an Internet search engine, online advertising, software and hardware.

General terms and conditions for the provision of electronic services:

2.1. The application is available to Users via the website at URL.
2.2. In order to use the Application, the User should have:
2.2.1. device with Internet access,
2.2.2. a web browser in a version not older than the one currently available,
2.2.3. Internet connection with a minimum bandwidth of 1 Mbit/s,
2.2.4. minimum screen resolution of 1920x1080px.
2.3. The Administrator reserves the right to change or limit the availability of the Application without prior notification to the User.

Registration

3.1. In order to use the Services available in the Application, the User should register and create an Account.
3.2. Account registration is free.
3.3. The user is obliged to provide true, current and complete data during registration and to update them in the event of a change in this data.
3.4. In order to register an Account, the User is obliged to provide the following data: name, surname, email address, password consisting of min. 8 characters and a combination of uppercase letters, lowercase letters and numbers, and optionally the ability to enter your location (e.g. country/city). The user is responsible for the accuracy and validity of the data provided by him/her.
3.4.1. In case of a forgotten password, the User will be able to use the 'forgotten password' procedure available on the login screen.
3.4.2. The User has the option to change his personal data and password in the settings of his Account after logging in to the Application.
3.4.3. The User has the option of deleting his Account by starting the account deletion procedure available after logging in to his Account.
3.5. The administrator reserves the right to reject a request for registration without giving a reason.
3.6. The Administrator reserves the right to delete the User's Account without giving any reason, in particular if the User does not meet the conditions set out in these regulations or if the User uses the Service in a manner inconsistent with its purpose or in a dishonest manner.
3.7. The Administrator reserves the right to block the User's Account if it is found to be using the Services fraudulently.
3.8. The Administrator is not liable for damages resulting from loss of access to the User Account, in particular due to forgetting or losing the password.
3.9. You are solely responsible for protecting your password against disclosure to third parties.
3.10. The User is solely responsible for all activities performed on his Account, in particular for all transactions made through his Account.
3.11. The user is required to provide his name, surname, e-mail address and password. Optionally, the User may provide his/her location (e.g. country/city).
3.12. In the event of a forgotten password, the User may use the "forgotten password" procedure available on the login screen, while changing the password is available in the settings after logging in to the Application.
3.13. Removal of the User Account by the User is possible after logging into the Application. After starting this procedure, the User's data will be deleted after 7 days.

Terms of use of the Application:

4.1. The User is obliged to use the Application in accordance with its intended purpose and with the Regulations.
4.2. The User may not use the Application for unlawful purposes, personal rights and goods protected by copyright.
4.3. The Administrator reserves the right to delete the User's Account in the event of violation of the provisions of the Regulations.

Services:

5.1. The Mana Vault app provides a collection management service for the Magic: The Gathering card game, allowing users to catalog their cards, view information about them, including current prices, and communicate with other users to trade cards.
5.2. The Mana Vault app is available for free (common plan) with some functional limitations.
5.3. Paid plans (Uncommon, Rare, Mythic) are also available in the form of a renewable 30-day subscription.
5.4. A detailed description of the available functionalities in individual plans can be found in the Price List tab on the Applications
website 5.5. Payments for paid plans and their renewals are handled by a third-party service provider. The Mana Vault app does not store payment card details.
5.6. After the end of the paid subscription, the user's account will be switched to the free plan (Common) while retaining the data available in the current plan.
5.7. Users of selected paid plans can manage their collection from the mobile application.
5.8. Currency conversions are based on current Google exchange rates.

Changes to the regulations:

6.1. The Administrator reserves the right to make changes to the Regulations.
6.2. Changes to the Regulations come into force after their publication on the website of the Application.
6.3. The user is obliged to read each change to the regulations before continuing to use the Mana Vault application.
6.4. If the user continues to use the application after the changes to the terms, this is considered acceptance of the changes.
6.5. The user's rejection of the changes to the regulations will trigger the Account deletion procedure after 7 days from the moment of rejection of the changes.

Personal Data:

7.1. The Administrator undertakes to protect the privacy of Users and their personal data, in accordance with the provisions of the Personal Data Protection Act.
7.2. Users' personal data are processed only for the purpose of providing the Service, and their processing is necessary to achieve the goals described in the Privacy Policy.
7.3. The user has the right to access their data and correct them, as well as request their removal.

Registration Form:

8.1. In order to use the Service, the User must complete the Registration Form, in which they provide their name, surname, e-mail address and password.
8.2. In the Registration Form, there is an option to provide your location (e.g. country/city), which is voluntary.
8.3. After completing the registration process, the User receives an activation link to the e-mail address provided, which must be clicked to activate the Account.
8.4. In the event of a forgotten password, the User may use the "forgotten password" procedure available on the login screen, while changing the password is available in the settings after logging in to the Application.
8.5. The User may start the procedure of deleting his Account, which will delete all User's data after 7 days from the moment of starting this procedure.

Price list:

9.1. The Mana Vault application is available for free (with limitations) or as a paid 30-day subscription in one of the packages described in detail in the Pricing tab.
9.2. The free (Common) plan has limitations as to the available functionalities, but it is valid indefinitely.
9.3. Paid plans (Uncommon, Rare, Mythic) are available as a renewable 30-day subscription.
9.4. After the end of the paid subscription, the User Account will be switched to the free plan (Common) while retaining the data available in the current plan.
9.5. Users of paid plans can manage their collection from the Mobile Application (Android) available in the Google Play store.

Responsibility:

10.1. The administrator does not warrant that the Mana Vault App will operate without interruptions or errors, or that all errors will be corrected.
10.2. The administrator reserves the right to a short technical break in the functioning of the application in the case of planned, ongoing service and maintenance of the server and website software.
10.3. The Administrator is not liable for damages resulting from improper operation or lack of operation of the Application.
10.4. The Administrator is not liable for damages caused by incorrect operation or lack of operation of the web browser or other software used by the User.
10.5. The administrator is not responsible for information provided by external service providers.

Final provisions:

11.1. The Regulations are a legal regulation between the User and the Administrator.
11.2. Any disputes between the User and the Administrator will be settled in the first place through negotiations. If it is not possible to resolve the dispute amicably, the matters will be resolved by the court competent for the seat of the Administrator.
11.3. The Regulations are available on the Mana Vault Application website and are made available to Users in order to familiarize themselves with its content.
11.4. The Regulations are a legal regulation in force at the time the User submits the Registration Form.
11.5. The Regulations are a legal regulation in force at the time the User purchases a paid plan.
